Win a $10,000 Website Package – Competition Terms & Conditions

Information on how to enter and prize details form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions.

Promoter and Permit Details

  • Promoter: Phase New Media Pty Ltd trading as Digital Dealer (ABN 37 098 105 965) of Level 2, Suite 2, 41 Sherwood Road, Toowong Queensland Australia. Phone: 1300 184 001.
  • Applicable Permits: This promotion is a trade promotion lottery. The Promoter will obtain all necessary permits as required under Australian law for the jurisdictions in which the promotion is conducted. Permit/Authority numbers will be printed here once issued. (Authorisations anticipated: SA Permit No. TBA, ACT Permit No. TBA.)

Promotional Period

  • Start Date: 28 July 2025 at 12:00am AEST.
  • End Date: 31 October 2025 at 11:59pm AEST.

All qualifying purchases must be completed and settled within this period to earn entries.

Eligibility

  • Eligible Entrants: Entry is open to all automotive dealerships and automotive manufacturers (“OEMs”) that are legally established and operating in Australia or New Zealand.
  • Each entry must be lodged by an authorised representative (employee, director or officer) of the dealership/OEM who is aged 18 years or older.
  • The authorised representative warrants that they have authority to bind the business to these Terms & Conditions.
  • Employees of the Promoter and their immediate families, and any agents or contractors directly involved with the administration of this promotion, are ineligible.
  • Ineligibility: Employees of the Promoter (Digital Dealer) and its related companies, agents, or distributors, as well as the immediate family members of such employees, are not eligible to enter. The Promoter may require entrants to provide proof of eligibility (e.g. proof of age, identity, employment or association with an eligible dealership/OEM). Businesses or individuals not meeting the above criteria are ineligible.

How to Enter

To enter the “Win a $10,000 Website Package” promotion, eligible entrants must meet the purchase requirement during the Promotional Period:

  • Entry Mechanism: For every ten (10) “Scooti” products purchased during the Promotional Period, the entrant will receive one (1) entry into the prize draw. Purchases are cumulative across the Promotional Period – multiple separate orders will be combined to calculate the total number of Scooti products purchased by each entrant. Example: If a dealer purchases 20 Scooti products, they will earn 2 entries; 15 products purchase earns 1 entry (with 5 carrying over toward the next entry). There is no upper limit on the number of entries an entrant can accumulate (each set of 10 products = 1 entry).
  • Qualifying Purchase Channels: Purchases must be made either through the Scooti Reviews website (the official online store) or via an authorised Digital Dealer sales channel (including purchases made directly from Digital Dealer representatives at the AADA Convention). Only purchases that are fully paid and confirmed by the end of the Promotional Period are eligible.
  • Proof of Purchase: Entrants should retain proof of purchase for each Scooti product order (e.g. receipts or invoices). The Promoter may, at its discretion, require entrants to provide proof of all qualifying purchases to verify entries. Failure to produce acceptable proof of purchase for any entry when requested may result in invalidation of those entries.
  • Entry Allocation: Entries are recorded automatically by the Promoter. Entrants do not need to submit any entry forms. Eligible purchases will be tracked and entries allocated accordingly by the Promoter’s system. The Promoter’s database and records of qualifying purchases shall be deemed conclusive in determining the number of entries for each entrant.
  • Excluded Transactions: If any purchase is cancelled, refunded, or otherwise reversed during the Promotional Period, the corresponding products will not count toward entries (and any provisional entries from such purchases will be removed). The Promoter reserves the right to disqualify any entrant who obtains entries by fraudulent or dishonest means (e.g. using fake orders, bulk buying intended solely for entries, or any breach of these Terms).

Note: “Scooti products” refers to products sold under the Scooti Reviews brand (such as the Scooti Google Reviews stands and related items). If you have any question about whether a purchase qualifies, please contact the Promoter during the Promotional Period.

Prize

  • Prize Description: There will be one (1) prize awarded. The prize is a Website Development and Maintenance Package for the winning dealership/OEM, provided by Digital Dealer. This includes professional website design and development services, and website maintenance services (such as hosting, support, or updates) for the winner’s business. The package can be used for a new website or redesign of an existing website (or multiple websites, if desired), up to the maximum value stated below.
  • Prize Value: The package is valued at up to AUD $10,000 (including GST), based on Digital Dealer’s standard recommended pricing for website development and maintenance services. The exact scope of services (e.g. number of websites, features, maintenance term) will be determined in consultation with the winner, ensuring the total retail value does not exceed $10,000. Any additional services or upgrades requested beyond the included value will be at the winner’s own cost by agreement. All taxes or costs associated with using the prize that are not expressly covered by the Promoter (excluding GST) are the responsibility of the winner’s business.
  • Conditions of Prize: The prize is not transferable to any third party and is not redeemable for cash or any other alternative. The prize is intended to be used by the winning entrant’s business (the dealership or OEM) for its own online presence. If the winner (business) is unable or unwilling to accept the prize as offered (for example, if they already have existing contractual commitments for web development), the prize may be forfeited and an alternate winner may be determined as described under “Unclaimed Prize” below.
  • Substitution: In the event that any element of the prize becomes unavailable for any reason (e.g. if Digital Dealer’s services cannot be provided due to unforeseen circumstances), the Promoter reserves the right to substitute the prize (or any part of it) with a similar product or service of equal or greater value, subject to any written directions from regulatory authorities. The Promoter will make every effort to ensure the substitute prize is as closely equivalent to the original prize as possible.
  • Prize Fulfillment: The Promoter will work with the winner to initiate the website development services as soon as practicable after the award. The winner must cooperate with Digital Dealer in providing necessary information, materials, and approvals for the website project. The Promoter will deliver or commence the prize services within 6 weeks of the winner being determined, unless otherwise agreed with the winner (or unless a longer period is approved by relevant regulators, if applicable). There is no additional fee for the provided services up to $10,000 value – any overages or additional features beyond the $10,000 cap will require the winner’s agreement and payment.

Draw and Winner Selection

  • Draw Date & Time: The prize draw will take place on 3 November 2025 at 12:00 pm (noon) AEST. (If permits are required, the draw will occur after all necessary permits are obtained. The above date may be adjusted in permit applications if needed; any change will be communicated in the final published Terms.)
  • Draw Location: The draw will be conducted at the Promoter’s office: Level 2, Suite 2, 41 Sherwood Road, Toowong Queensland Australia (or an alternate venue in Brisbane of the Promoter’s choosing, subject to notice).
  • Draw Method: The winner will be determined by a random draw from all valid entries received. The draw may be conducted manually (e.g. drawing from a barrel or container) or via a computer-generated random process, at the Promoter’s discretion. An independent scrutineer will observe the draw and the announcement of the winner, to ensure fairness and compliance with regulations.
  • Winner Selection: The first valid entry drawn will be deemed the winner (subject to verification of eligibility and compliance with these Terms). The winning entry will correspond to the business (dealership/OEM) that made the qualifying purchases. Only one prize will be awarded in total.
  • Entry Verification: The Promoter reserves the right to verify the validity of all entries and the eligibility of the entrants (including the legitimacy of purchases, and the entrant’s identity and age). The Promoter may disqualify any entrant or entry that, in its opinion, engages in unlawful or improper conduct, or otherwise breaches these Terms and Conditions. This includes but is not limited to entrants who tamper with the entry process or attempt to claim entries they are not entitled to. The Promoter’s verification process may involve checking purchase records and contacting the entrant or the associated business for clarification. Failure to respond to information requests may result in disqualification.
  • Promoter’s Decisions: The result of the draw is final. The Promoter’s decisions regarding all aspects of the competition (including verification and disqualification matters) are final and binding, and no correspondence will be entered into.
  • Disputes: In the event of a dispute as to the identity of an entrant or ownership of qualifying purchases, the entry will be deemed to have been submitted by the authorised representative of the dealership/OEM that is listed on the purchase record. If multiple employees of a dealership are involved in purchases, the winner will be awarded to the dealership as an entity (with the prize to be claimed by the owner or an authorised manager of that dealership). The Promoter may require proof that an individual claiming to be the winner is authorised to act on behalf of the winning business. In any case of dispute, the Promoter reserves the right to make the final determination of the winner’s identity.

Winner Notification and Prize Claim

  • Notification of Winner: The provisional winner will be notified by the Promoter within 2 business days of the draw. Notification will be made via the contact details associated with the winner’s entries – this will include at minimum an email to the email address used for the qualifying purchases (and if available, a phone call to the provided number). The Promoter will make reasonable efforts to contact the winner personally using these contact methods. Once contact is made, the winner may be required to confirm eligibility and acceptance of the prize.
  • Public Announcement: In addition to individual notification, the winner’s name, business name, and state (or city) of residence will be announced to all entrants by email and also published on the Promoter’s website (on a dedicated competition results page) within 7 days of the draw. This public announcement is done in accordance with regulatory requirements for prize promotions over $500 in value. By entering, the winner consents to this publication of their name and business if they win.
  • Prize Claim Deadline: The winner must respond to the Promoter’s notification and claim the prize within 1 month of the draw date. (That is, by 4 December 2025 unless an alternate deadline is specified in winner communications.) Claiming the prize will typically involve the winner confirming acceptance and arranging with the Promoter to begin the website development process. If the winner does not respond or is unable to be contacted despite the Promoter’s reasonable efforts (including if emails are returned undeliverable and phone calls are not returned) or if the winner fails to formally accept the prize by the deadline, the winner will be deemed to have forfeited the prize.
  • Unclaimed Prize Draw: If the prize is unclaimed or forfeited by the initial winner by the above deadline, a redraw will be conducted. The unclaimed prize draw (if needed) will take place on 11 December 2025 at 12:00 pm AEST at the same location as the original draw, subject to any necessary approval by regulatory authorities. All eligible entrants in the original draw (except the original winner, if later disqualified or forfeited) will be included in the redraw. An independent scrutineer will also oversee any redraw. The redraw will follow the same procedure – one valid entry will be drawn at random to determine the new winner.
  • Notification of Redraw Winner: The winner from any unclaimed prize redraw will be notified by email and/or phone within 2 business days of the redraw, and their details will be published on the Promoter’s website (and/or via email to entrants) within 7 days of the redraw, in the same manner as the original draw winner notification. The redraw winner will have 14 days from the redraw date to claim the prize. If the redraw winner also fails to claim the prize in that time, the Promoter will consult with the relevant regulatory authorities for further direction (e.g. a second redraw or alternative distribution of the prize). The Promoter’s goal is to ensure the prize is awarded to an eligible entrant; however, no prize will be awarded if the relevant regulators direct the Promoter that it be void.

General Terms

  • Overall Compliance: This promotion is conducted in accordance with Australian consumer and gaming laws, including the conditions of any required permits. The Promoter will ensure all necessary steps are taken to fairly administer the competition and deliver the prize as advertised, or an equivalent prize if circumstances require (consistent with the permits and approvals obtained. Entrants agree that the Promoter may amend these Terms and Conditions if required to comply with any law or directions from applicable authorities, provided such changes do not unfairly disadvantage entrants. Any updates to the Terms (e.g. change of dates due to permit timing) will be communicated on the Promoter’s website.
  • No Fees to Enter: There is no entry fee charged to participate in this promotion. The only requirement is the purchase of products as described above, and any ordinary costs associated with making such purchase (e.g. internet access or travel to the convention) are the entrant’s responsibility. The promotion is marketed as a trade promotion to reward customers; it is not intended as a “lottery” for profit. All valid prize claims will be honoured as outlined in these Terms, and no additional charges apply to redeem the prize.
  • Liability: To the fullest extent permitted by law, the Promoter, its related companies and agencies, and each of their officers and employees, will not be liable for any loss, damage, expense, or injury whatsoever (including indirect or consequential loss) sustained by any entrant or winner in connection with this promotion or the acceptance or use of the prize. The winner (business) accepts that the development of a website is a collaborative process; the Promoter will exercise due skill and care in delivering the prize services, but makes no guarantee that the outcome will meet any specific business objectives of the winner beyond the standard scope of services. Nothing in these Terms restricts consumers’ rights under the Australian Consumer Law. In the event of major technical failures, acts of God, or other events beyond the Promoter’s reasonable control that interfere with the competition (e.g. website outages preventing purchases, or the cancellation of the AADA event), the Promoter will not be liable, but will take appropriate steps to either allow delayed entries or to modify or cancel the promotion with regulatory approval if necessary.
  • Right to Disqualify or Modify: If there is any reason to suspect that an entrant has breached these Terms, or engaged in any unlawful or improper misconduct calculated to jeopardise the fair and proper conduct of the promotion, the Promoter reserves the right to disqualify that entrant and all associated entries. Any attempt to cause damage to any website or platform used in this promotion, or to undermine the legitimate operation of the promotion, may be a violation of criminal and civil laws. The Promoter also reserves the right to cancel, terminate, modify or suspend the promotion subject to any applicable laws or regulations – for example, if the promotion cannot run as planned due to technical failures (such as computer viruses, bugs, tampering) or other causes beyond the Promoter’s control. If the Promoter does cancel or modify the promotion, it will do so with the agreement of any relevant regulators and will inform participants of the changes in a timely manner.
  • Ownership of Entries: All entries (qualifying purchase records) become the property of the Promoter. The Promoter may retain documentation of entries and winners as required by law (such as keeping a record of the draw and prize award for at least 3 months). No entries will be returned to entrants.
  • Privacy: The Promoter will collect and use personal information about entrants (for example, names, business names, email addresses, phone numbers, and purchase details) for the purposes of conducting this promotion and for directly related purposes. This may include sharing relevant information with agencies assisting with the promotion, with regulators (if required for permits or compliance), or with service providers (such as IT or communication providers). Entry in the promotion is conditional on providing this information. The Promoter will handle personal information in accordance with its Privacy Policy and the Australian Privacy Principles. Entrants can contact the Promoter to access, update or correct their personal information.
  • Marketing Communications: By entering this promotion, entrants acknowledge that the Promoter may also use their personal information to communicate with them about the Promoter’s products, services and future promotions. If an entrant does not wish to receive marketing communications unrelated to this competition, they may opt out at any time (for example, by using an unsubscribe link in emails or by contacting the Promoter). The Promoter’s Privacy Policy provides further details on how to opt out and how personal information is handled.
  • Publicity & Release: By accepting the prize, the winner agrees that the Promoter may use the winner’s name, business name, logo (if applicable), and general location (e.g. city or state), as well as any photographs or testimonials the winner provides, for promotional purposes. This includes announcements about the competition results, case studies, media releases, social media content, and marketing materials promoting the Promoter’s services, without further compensation. The winner may also be asked to participate in reasonable publicity activities (such as an interview or providing a statement about the prize experience), but this is optional.
  • No Association with Third Parties: This promotion is in no way sponsored, endorsed or administered by, or associated with, any third party unrelated to the Promoter.
  • Governing Law: These Terms and Conditions are governed by the laws of Australia. In the event of any dispute or claim arising out of or in connection with the promotion, entrants agree to submit to the jurisdiction of the courts of the Promoter’s home state (Queensland). All entrants agree to act in good faith with respect to any dispute and to attempt to resolve issues through negotiation with the Promoter before taking any formal action.
  • Permit Compliance: This promotion is conducted under the permits/authorities mentioned above. The promotion shall also be subject to any additional conditions imposed by those permits. If any provisions of these Terms are inconsistent with the conditions of a permit, the permit conditions will prevail to the extent of the inconsistency. The Promoter warrants that it will conduct the promotion in accordance with all applicable laws and permit requirements, including (but not limited to) ensuring fair draw procedures, proper notification of winners, and award of the prize as described.
